Terms & Conditions – Once Upon a Song
These Terms & Conditions apply to all services provided by Once Upon a Song. By enquiring, commissioning a song, booking a live performance, or using this website, you agree to the terms outlined below.
1. Services
Once Upon a Song provides bespoke songwriting services, creating personalised songs based on information supplied by the client. Each song is uniquely written and tailored to the individual commission.
2. Commission Process
- All commissions begin with an initial consultation to discuss your ideas, story, and specific requirements.
- A non-refundable deposit of 50% of the total fee is required to secure your booking.
- Each song will be composed in my signature singer-songwriter style, featuring piano and vocals, unless otherwise agreed.
- An initial draft of the song will be delivered to the client.
- The client may request up to two revisions. Any additional revisions beyond this will incur an additional charge.
- Once the song is approved by the client, the remaining 50% balance is due. The song will then proceed to the mixing and mastering stage. Revisions are no longer possible once this stage has begun.
3. Pricing & Payment
- Prices for personalised songs start from £390.
- Final pricing will be confirmed before work begins.
- Any additional charges throughout the process will be agreed with the client in advance.
4. Delivery
- Completed songs will be delivered as a professional MP3 or WAV file, unless otherwise agreed.
- Delivery timescales will be discussed during the consultation and confirmed in the initial quote. These may vary depending on project scope and availability.
5. Copyright & Usage
- Once Upon a Song retains the full copyright to all compositions.
- Clients are granted a licence for personal, non-commercial use only, such as gifts, private events, and sharing with friends and family.
- Commercial use, reproduction, distribution, or resale of the song is strictly prohibited.
6. Social Media & Portfolio Use
- Once Upon a Song may share songs or excerpts (including audio clips, lyrics, or performance videos) on social media, website portfolios, or promotional materials.
- Consent will always be obtained before sharing any personal or identifiable content, including client names, images, or video footage.
- Clients may request that their song and personal content not be shared publicly at any time.
7. Client Responsibilities
Clients are responsible for providing accurate and appropriate information for the creation of their song. Once Upon a Song is not liable for issues arising from incomplete, inaccurate, or misleading information supplied by the client.
8. Cancellations
No refunds are available once the 50% deposit has been paid.
9. Limitation of Liability
While every effort is made to deliver a high-quality service, Once Upon a Song shall not be liable for any indirect, incidental, or consequential losses arising from the use of this website or services.
10. Website Use
Content on this website is provided for general information only and may be updated at any time. Unauthorised reproduction, distribution, or use of website content is prohibited.
Event Performance Terms & Conditions
These Terms & Conditions apply to all live performance bookings made with Once Upon a Song. By booking a performance, you agree to the following terms:
11. Live Performances
Live performance starts from £200 and is subject to scheduling and location.
12. Booking & Confirmation
- All bookings are subject to availability and are only confirmed once the required deposit has been received.
- Upon confirmation, the client will receive written confirmation via email outlining any agreed requirements.
13. Payment Terms
- A non-refundable deposit of 50% of the total performance fee is required to secure the booking date.
- The remaining 50% balance is due 14 days before the event.
- Failure to pay the remaining balance by the due date may result in cancellation of the booking, with the deposit retained.
14. Cancellations & Refunds
If the client cancels:
- More than 14 days before the event – no further charges will apply, but the deposit remains non-refundable.
- Less than 14 days before the event – no refund will be given.
If Once Upon a Song is required to cancel due to illness, emergency, or circumstances beyond reasonable control, every effort will be made to:
- Reschedule the booking, or
- Issue a full refund, including the deposit.
No further liability shall be accepted beyond the refund of fees paid.
15. Event Details & Client Responsibilities
The client agrees to provide accurate event details, including:
- Event date
- Performance time
- Venue address
- Parking and access information
- Any specific performance requirements
The client is responsible for ensuring:
- Safe and suitable performance conditions
- Adequate weather protection for outdoor events
- A suitable performance space, including access to electricity where required
Once Upon a Song reserves the right to pause or stop a performance if conditions are deemed unsafe.
16. Equipment & Technical Requirements
Once Upon a Song will provide necessary performance equipment unless otherwise agreed in writing.
17. Photography & Video Recording
- Photographs or short video recordings may occasionally be taken during performances for promotional purposes.
- No identifiable images or recordings will be shared publicly without the client’s prior consent.
- If you do not wish any photography or recording to take place, please notify us before the event.
18. Liability
Once Upon a Song shall not be held liable for:
- Delays caused by traffic, severe weather, or circumstances beyond reasonable control
- Event disruptions outside of our control
- Indirect or consequential losses
Total liability shall not exceed the total performance fee paid.
19. Force Majeure
Neither party shall be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to:
- Extreme weather
- Natural disasters
- Government restrictions
- Illness or emergencies
In such cases, efforts will be made to reschedule or refund as appropriate.
20. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
